1. Acceptance of these terms
By accessing or using this website you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the site. If you use the site on behalf of a business, you confirm you are authorized to bind that business to these terms.
2. Use of the site
You agree not to:
- Use the site for any unlawful purpose or in breach of any applicable Alberta or Canadian law.
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the site or its systems.
- Scrape, harvest, or reproduce site content at scale without our written permission.
- Submit false, misleading, or fraudulent information through our forms.
We may suspend or terminate access to the site at any time, without notice, where we reasonably believe these terms have been breached.
3. Product information and performance figures
Performance figures shown on this site — including fuel economy improvements, emissions reductions, power and torque results, and customer statements — are drawn from laboratory testing, field trials, and reports from customers. Results vary with engine type, condition, fuel quality, load, maintenance, and operating conditions.
These figures are provided for information only and are not a guarantee, warranty, or representation that you will achieve any specific result.
4. Orders, quotes, and pricing
Orders and quote requests submitted through this site are requests only and do not create a binding contract. A contract is formed only when we confirm your order in writing.
Pricing, availability, product specifications, and lead times are subject to change without notice. We may decline or cancel any order, including where there has been an error in pricing or product information. Applicable Alberta and Canadian taxes, shipping, and handling may be added.
5. Safe handling and product use
You are responsible for using our products in accordance with the applicable Safety Data Sheet, the product user guide, dosage instructions, and all applicable health, safety, environmental, and transportation regulations. Read the Safety Data Sheet before handling the product.
Nothing on this site is engineering, environmental, regulatory, or legal advice for your specific operation.
6. Intellectual property
All content on this site — including text, graphics, logos, product names, images, video, documents, and layout — is owned by ClearSky Complete or its licensors and is protected by Canadian and international intellectual property laws. You may view and print content for your own internal, non-commercial use. Any other reproduction, distribution, or modification requires our prior written consent.
7. Third-party links and embedded content
The site may link to or embed third-party content, including forms, video players, and documents. We do not control that content and are not responsible for its accuracy, availability, or privacy practices. Your use of third-party services is governed by their own terms.
8. Disclaimer of warranties
Except where prohibited by applicable consumer protection law, this website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the maximum extent permitted by law, ClearSky Complete and its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of this site.
Nothing in these terms limits liability that cannot be limited under Alberta or Canadian law, including under the Alberta Consumer Protection Act where it applies.
10. Indemnity
You agree to indemnify and hold harmless ClearSky Complete from any claims, losses, liabilities, and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your improper handling or use of our products.
11. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict of law rules. You agree to the exclusive jurisdiction of the courts of Alberta for any dispute arising from these terms or your use of this site.
12. Changes and contact
We may update these terms at any time. The updated version takes effect when posted, and continued use of the site means you accept it. Questions about these terms can be sent to sales@clearskycomplete.com.
